OMNI Healthcare Patients: Important Information Concerning Your Care

I, David J. Malis, M.D., am no longer affiliated with OMNI Healthcare [“OMNI”].

I sincerely appreciate the trust and confidence that you, parents and referring physicians, have in me. The differences with OMNI make it impossible for me to remain associated with that organization. However, I remain committed to providing my unique medical and surgical consultative skills to the children of Brevard and Indian River Counties and have chosen to continue to practice medicine in this community. Unfortunately, due to legal constraints, regretfully, I am prohibited from caring for any of my former OMNI patients or establishing a new patient relationship if your child has been seen by any other OMNI physician for three (3) years (this legal constraint expires on 22 December 2011). So that there are no misunderstandings, please note the following:

Patients Dr. Malis is permitted to see:

Any child NOT previously seen by Dr. Malis or any OMNI physician (even if a sibling has been seen by Dr. Malis or any OMNI physician).

For families with several children, if a sibling (for example: Jimmy) was seen by Dr. Malis while associated with OMNI but the Consultation/New Patient visit is for a new, different, child (for example: Karen) NOT previously seen by Dr. Malis (or any OMNI physician), then Dr. Malis is permitted to see the new child (Karen). However, Dr. Malis is NOT permitted to see the previously seen child (Jimmy). New patients/parents will need to sign the attached Disclaimer which will be notarized by Dr. Malis’ Receptionist at the initial office visit attesting to the above.

Patients Dr. Malis is not permitted to see:

Any child previously seen by Dr. Malis or any OMNI physician. Unfortunately, if it is later discovered that the Disclaimer was falsified, your child will be immediately discharged from the practice.

Additionally, in accordance with Florida statute, this is notice that all medical records of patients during Dr. Malis’ affiliation with OMNI Healthcare remain under the care of OMNI Healthcare:
